Acceptance of Terms

By accessing or using the FoundryPulse platform ("Services"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not access or use the Services.

Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction, and authorized by your organization, to access or use the Services. You represent that the information you provide is accurate and that you are using the Services for business or industrial purposes.

Account Registration

To use FoundryPulse features, you must have an account. You are responsible for maintaining the confidentiality of your credentials and for any activity under your account. You agree to notify us immediately if you suspect unauthorized use.

Use of the Services

You agree to use the Services only for lawful purposes, in accordance with all applicable laws, and in a manner consistent with your organization’s operations. You may not:

• Access or attempt to access data not intended for your organization
• Upload malicious code or interfere with the operation of the platform
• Use the Services to violate any laws or regulations
• Reverse engineer, copy, or replicate any aspect of the platform

Device & Telemetry Data

You grant FoundryPulse the right to process, store, and analyze telemetry and operational data from your registered devices to provide Services such as real-time monitoring, alerts, analytics, and diagnostics. You retain ownership of your raw data.

Subscription & Billing

Access to the Services requires a subscription. Pricing, billing frequency, and usage limits will be detailed in your agreement or invoice. Failure to pay may result in suspension or termination of Services.

Intellectual Property

All content, software, and technology used to provide the Services are the property of FoundryPulse or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the platform solely for your organization’s internal operations.

You grant FoundryPulse a worldwide, royalty-free license to use, host, and process device telemetry solely to provide and improve the Services, including diagnostics and aggregated analytics. Aggregated data that cannot identify your organization may be used to improve platform performance.

Downtime and Maintenance

FoundryPulse may perform scheduled or emergency maintenance that temporarily affects platform availability. While we strive for high uptime, we do not guarantee uninterrupted access and are not liable for downtime or data loss.

Termination

We may suspend or terminate your access if you violate these Terms, misuse the Services, or if required by law. You may also terminate your use at any time by contacting support. Upon termination, your access will be disabled and data will be deleted per our Privacy Policy.

Disclaimers

The Services are provided "as is" and "as available." We do not warrant that the platform will be error-free, uninterrupted, or that results will be accurate. You assume full responsibility for use of the Services and any decisions based on telemetry data.

Limitation of Liability

To the fullest extent permitted by law, FoundryPulse shall not be liable for any indirect, incidental, or consequential damages, including lost data, lost profits, or equipment damage, arising from your use of the Services.

FoundryPulse integrates with third-party hardware and network devices. We make no warranties regarding the operation or performance of third-party products or integrations and are not responsible for resulting downtime or inaccuracies.

Modifications

We may update these Terms from time to time. Changes will be effective upon posting, and your continued use of the Services signifies acceptance. We encourage you to review the Terms regularly.

Governing Law

These Terms are governed by the laws of the State of Iowa, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Linn County, Iowa.

Service Modifications and Suspension

We may modify, suspend, or restrict the Services (in whole or part) to maintain security, comply with law, or prevent harm to our infrastructure or customers. Where practicable, we will provide notice of material changes or outages.

Indemnification

You agree to indemnify and hold harmless Blueprint Software LLC, its affiliates, and employees from any claims, damages, or expenses arising from your organization’s use of the Services, violation of these Terms, or infringement of third-party rights.

Entire Agreement

These Terms, together with any applicable subscription or service agreement, constitute the entire agreement between you and Blueprint Software LLC regarding the Services. If any provision is found invalid, the remaining provisions will continue in full force.
